Insurance company wins case

It took a little more than an hour for a Litchfield Superior Court jury of six to agree a Naugatuck chiropractor was wrong in filing a civil suit against her insurance company for failing to pay a $7,000 monthly benefits claim.

They agreed she was so wrong, in fact, that they also agreed she should pay back the $84,000 she received from the Hartford Life and Accident Insurance Co., possibly with interest.

Superior Court Judge John Danaher has yet to rule on whether Cheryl M. Schiano should also be made to pay $30,000 in interest that has accrued on the principle since 2007 when she received payments of $7,000 per month for a year.

Jurors heard seven days of testimony last week before deliberating Friday. Post trial motions are expected and have yet to be heard. Schiano has until mid June to file an appeal.
