Local chiropractic firm to pay $95K in discrimination lawsuit

PHILADELPHIA — The U.S. Equal Employment Opportunity Commission Wednesday reported that a Delaware County chiropractor’s company will pay $95,000 to settle a pregnancy discrimination lawsuit involving a former associate chiropractor employed there.

The EEOC charged in its lawsuit filed in U.S. District Court that Delaware County Pain Management, 1308 MacDade Blvd., in the Folsom section of Ridley Township, terminated Dr. Kristina M. Shuffler of Media because of her pregnancy.

Shuffler, 38, began working for the pain treatment center in December 2005. The EEOC charged that after she advised her supervisor about her pregnancy, her supervisor made derogatory comments about Shuffler’s pregnancy.

In September 2006, Shuffler had to go on medical leave because of pregnancy-related health problems, according to the EEOC. In November 2006, the supervisor left a voice-mail message for Shuffler telling her she was no longer needed at the office, the EEOC stated.

The EEOC charged that the company terminated Shuffler because of her pregnancy. Such alleged conduct violates Title VII of the Civil Rights Act of 1964. The EEOC filed suit after first attempting to reach a voluntary settlement.

The EEOC enforces federal laws prohibiting employment discrimination.

“The commission thanks Delaware County Pain Management for its cooperation in resolving this case and for taking steps to ensure other women in the workplace will not be forced to choose between parenthood and a livelihood,” said EEOC Acting Regional Attorney Debra Lawrence.

Shuffler could not be reached for comment. Her lawyer, Nancy DeMis of Media, confirmed that the “matter is resolved,” but declined further comment.
